Terms and conditions

Meet the Fantasy · version [1.0] · effective from [date]

Draft. These terms and conditions are a first draft and have not yet been legally reviewed. Have them reviewed by a lawyer before the site goes live, paying particular attention to the Dutch rules on package travel and mandatory insolvency protection when travel services are combined. Text between [ ] still needs to be completed.

Article 1 – Definitions

In these terms:

  • Meet the Fantasy: [legal form and registered name], established in Amsterdam, registered with the Dutch Chamber of Commerce under number [number];
  • Client: the natural or legal person who submits a request or enters into an agreement with Meet the Fantasy;
  • Agent: the independent professional who designs and organises an experience for the client on behalf of or in cooperation with Meet the Fantasy;
  • Experience: the bespoke service or combination of services described in the proposal;
  • Recipient: the person to whom the client gives an experience as a gift;
  • Proposal: the written quotation describing the experience, planning and price.

Article 2 – Applicability

These terms apply to every request, proposal and agreement between Meet the Fantasy and the client. Deviations are only valid if agreed in writing. The client’s own terms do not apply.

Article 3 – Request and proposal

A request via the website is without obligation. Based on the request, the agent prepares a proposal. A proposal is valid for [30] days unless stated otherwise. Availability of components is only guaranteed after confirmation by Meet the Fantasy.

Article 4 – Formation of the agreement

The agreement is concluded when the client accepts the proposal in writing or digitally and Meet the Fantasy confirms this acceptance. Meet the Fantasy is the client’s contracting party; the agent performs the work under the responsibility of Meet the Fantasy.

Article 5 – Role of the agent

The agent is the client’s dedicated point of contact. Meet the Fantasy selects agents carefully and monitors the quality of their work. [Describe whether the agent is employed, self-employed or acts as an intermediary.]

Article 6 – Prices and payment

All prices are in euros and include VAT unless stated otherwise. For legal reasons and to protect both client and agent, all payments are processed by Meet the Fantasy in the Netherlands. Payments to the agent or third parties outside Meet the Fantasy are not permitted.

Payment can be made with Visa, Mastercard and iDEAL | Wero. Unless agreed otherwise, the following payment schedule applies:

  • a deposit of [30]% upon acceptance of the proposal;
  • the balance no later than [6] weeks before the date of the experience.

In the event of late payment, Meet the Fantasy may terminate the agreement after a written reminder, in which case Article 8 applies.

Article 7 – Right of withdrawal

Services relating to leisure activities on a specific date or within a specific period, such as travel, accommodation, events and dinners, are not subject to the statutory right of withdrawal (Article 6:230p Dutch Civil Code). Statutory rules apply to other components.

Article 8 – Cancellation by the client

The client may cancel the agreement in writing. The following costs apply:

  • up to [90] days before the experience: the deposit;
  • [89] to [30] days before the experience: [50]% of the total price;
  • less than [30] days before the experience: [100]% of the total price.

If third parties (such as hotels, carriers or events) apply stricter cancellation terms, these are stated in the proposal and apply. We recommend taking out cancellation insurance.

Article 9 – Changes

Requests from the client to change the experience will be accommodated where possible; any additional costs will be communicated in advance. Meet the Fantasy may change components due to circumstances beyond its control, provided the experience remains equivalent. If that is not possible, the client may cancel free of charge.

Article 10 – Experiences as a gift

An experience may be given as a gift. The client remains responsible for payment. The date is set in consultation with the recipient. A gift is valid for [12] months, may be transferred to another person after consultation and cannot be exchanged for cash, unless the law provides otherwise.

Article 11 – Obligations of the client

The client provides correct and complete information in good time, such as travel documents, dietary requirements and relevant medical details. The client is responsible for valid travel and identity documents.

Article 12 – Liability

Meet the Fantasy performs the agreement with due care. Liability is limited to the amount paid by the client for the experience concerned, except in the case of intent or gross negligence, and except where the law does not permit such limitation, such as for package travel.

Article 13 – Force majeure

In the event of force majeure, including natural disasters, pandemics, war, government measures and serious disruptions at carriers, Meet the Fantasy may suspend performance or terminate the agreement. Amounts already paid will be refunded insofar as they are not owed to third parties.

Article 14 – Complaints

Complaints during the experience must be reported to the agent immediately so that a solution can be found on the spot. Complaints afterwards must be submitted in writing within [30] days via [complaints@meetthefantasy.com]. Meet the Fantasy will respond within [14] days.

Article 15 – Privacy

Meet the Fantasy processes personal data in accordance with the General Data Protection Regulation (GDPR). See the privacy policy. Agents are bound by confidentiality.

Article 16 – Governing law and disputes

These terms and all agreements are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam, unless the law prescribes otherwise. Consumers may always turn to the court of their place of residence.
